R.A. 10172), Notice is hereby served to the public that CECILIA BALAI NAGUM has
filed with this Office a petition for correction of entry in sex from MALE to
FEMALE in the certificate of live birth of CECILIA AGOR BALAI at Sarrat, Ilocos
Norte and whose parents are EPIFANIO RAMOS BALAI and SOLEDAD GAMAS AGOR.
Any person adversely affected by said
petition may file his written opposition with this Office not later than Dec.
26, 2016.

COMES NOW Petitioner by undersigned
counsel unto this Honorable Court, she most respectfully avers, that:
1.
She is of legal age, married, Filipino, and a resident of Brgy.
#16-Carusipan, Pasuquin, Ilocos Norte, the same address where she may be served
with notices, pleadings, orders and other processes of the Honorable Court, a
copy of her Certificate of Live Birth issued by the National Statistics Office
(NSO) to prove her identity is hereto attached as Annex “A”, the Certification
issued by the Barangay Chairperson or Punong Barangay that Petitioner is a
resident of Barangay Carusipan Pasuquin, Ilocos Norte, as well as a copy of
petitioner’s Community Tax Certificate (sedula) to prove such residence are
hereto attached as Annexes “B” and B-1” respectively;

Respondent, MARCELINO M. MADRIAGA, is of legal age, married,
Filipino, and a resident of Barangay An-Annam West, Bantay, Ilocos Sur, the
same address where he may be served with summons, notices, pleadings, orders
and processes of this Honorable Court, a copy of his Certificate of Live Birth
duly issued by the NSO is hereto attached as Annex “C”;

Petitioner and respondent herein entered into a Contract of
Marriage on December 05, 199i8 at the Christ The King Parish Church in Barangay
Paing, Bantay, Ilocos Sur officiated by the parish priest- REV. FATHER GABRIEL
RAMOS, a copy of their Marriage Contract/Certificate of Marriage duly issued by
the National Statistics Office (NSO) is hereto attached as Annex “D” and made
an integral part hereof;

The parties herein have no real or personal properties which may
form part of their absolute community of property but they have common children
by the names of EARLE JADE RABARA MADRIAGA who was born on December 18, 1999
and ARA JANE RABARA MADRIAGA who was born on June 18, 2004, copies of their
children’s Certificate of Live Birth duly issued by the NSO and hereto attached
as Annexes “E” and “F”, respectively, and made as integral parts hereof;

She is presently a social worker at the Municipal Social Welfare
and Development Office (MSWDO) in the Municipality of Bantay, Province of
Ilocos Sur while respondent is an Overseas Worker (OFW) in Paris, France;
6.
Petitioner and respondent grew in the same barangay and both
attended the Tay-Ac Elementary School and the Ilocos Sur National High School.
They separated ways when during college but their paths crossed in 1997 during
an excursion in one beach sometime in December of that year;

When they saw each other, herein petitioner-GINA and respondent
MARCELINO were also reunited with their buddies from grade school, and the
moment they saw each other, mutual attraction developed. They talked the whole
night and before they parted ways at the end of the excursion, respondent told
petitioner his intention to court her;

Because of the vouching of their friends coupled with the mutual
attraction and intense infatuation they had for each other, herein
respondent-MARCELINO then became more and more determined to pursue herein
petitioner-GINA. Lunchtimes were then spent together at the house of MARCELINO,
and most of the time, the latter would fetch GINA and bring her home thru his
tricycle as he was then a tricycle driver. Such constant togetherness made the
two closer to each other until GINA finally accepted MARCELINO as her
sweetheart sometime in February, 1998;

GINA employed every moment with MARCELINO especially that the
latter was protective of her, and despite his sternness when it comes to GINA’s
attendance to her activities in line with her job and his insistence to be with
her almost all the time where wherever the latter would go, GINA took
MARCELINO’s attitude go, GINA took MARCELINO’s attitude as an indication of his
being caring;
10. Resulting from their
togetherness and the seemingly affectionate gestures of MARCELINO towards GINA,
it was not too long that the latter surrendered herself to him. Sexual intimacy
became frequent to the couple, and MARCELINO would be the one looking and initiating
for it. And as time passed, MARCELINO began talking to how much he wanted to
have a child with GINA but which the latter often dismisses and treats it as a
small talk;
11.
As time passed however, MARCELINO began telling GINA of his
intention to marry her. Considering that GINA was not yet prepared for
marriage, she rarely entertained such topic with him, but MARCELINO would
always say the he does (did) not want to end up like his uncle who never sired
a child;
12. Because of GINA’s apprehension
towards MARCELINO’s intention for marriage, the latter was prompted to
clandestinely sought the approval of GINA’s mother and scheduled a date of the
so-called “pamamanhikan” of the official visitation of a man with his family
unto the woman’s family to convey the man’s sincere feelings and intention for
marriage;
13.
Apparently, the said “pamamanhikan” pushed thru and seemingly,
GINA’s parents were convinced by MARCELINO despite GINA’s reluctance. However,
the latter did not want to go against what her parents wanted for her and just
admitted and accepted the pact which her parents and MARCELINO’s folks agreed
upon;
14. Such being the case, MARCELINO
and GINA tied the knot on December 5, 1998 at the Christ The King Church in
Barangay Paing, Bantay, Ilocos Sur wherein the relatives of both sides were
complete in attendance. It was MARCELINO’s siblings working in Paris, France
who sent money for the youngest brother’s wedding;
15. Despite GINA’s trepidation due
to her unpreparedness at the onset, she conditioned herself to be MARCELINO’s
wife. This is not to say, however, that GINA did not love MARCELINO. In fact,
even before the marriage, GINA already fell in love with much sincerity towards
MARCELINO, but she was just not yet prepared to get married because she was
thinking of a better and more stable life prior to marriage;
16. After the wedding, the couple
established their residence at the house of MARCELINO’s parents in Sitio West
An-Anam, Bantay, Ilocos Sur. GINA continued to work while MARCELINO just periodically
drove his tricycle only in those times he felt and wanted to work. It then
became obvious that GINA was becoming the breadwinner for the entire family,
including MARCELINO’s household, especially that the remittances from Paris,
France dwindled and became inconsistent;
17. GINA’s meager salary as a Day
Care worker of the MSWDO was not enough for the family’s needs. In spite of
life’s difficulties, GINA was also faced with MARCELINO’s issue that he wanted
to have a child with her as MARCELINO never wanted to be like his uncle who was
not able to sire a child;
18. MARCELINO constantly demanded
that GINA gave her a child and arguments would always ensure because the former
would accuse his wife preventing her pregnancy. And with the suspicion,
MARCELINO even insisted and forced sexual intercourses with GINA just to
fulfill his wish;
19. GINA then got pregnant, and
from then on, MARCELINO became even more protective and strict forbidding GINA
to attend the required activities in relation to her work. MARCELINO’s
suspicion developed into paranoia so that he would consistently chastise her
whenever he needs to do her work-related undertakings, and he would even
monitor and watch over his wife’s activities;
20.MARCELINO’s paranoia translated into his over displays of
irrational sensitivity and jealousy which also irritated GINA and caused her
much stress, and as a result, arguments often ensued between them.
21. GINA gave birth to EARLE JADE
but not even the advent of their first child eased MARCELINO as he even began
complaining about the time GINA was spending at work. Almost every day,
MARCELINO demanded that GINA should quit her job but the latter never gave it
up because it was she who was supporting almost the whole family as her husband
became lazier and lazier each day that passes by.
22. GINA always reminds MARCELINO
that they will not be able to fill their stomachs if she will accede to his
demands considering that the dwindling financial aid coming from Paris, France
was just for MARCELINO’s parents and not for them. Unfortunately, MARCELINO
refused to listen and realize the matter which resulted in heavy arguments and
fights whenever GINA comes home from work and related activities.
23. MARCELINO’s unfounded
jealousness and innate insecurities became more and more apparent and to
overcome this, he would always demand sexual intercourse from his wife as a
reaffirmation that he owns GINA and that no one else than him alone could enjoy
and utilize his wife. This was something which herein GINA observed, felt, and
heard from her husband, herein respondent MARCELINO;
24.Because of MARCELINO’s sexual aggressiveness to overcome
his jealousies and insecurities, GINA got pregnant and gave birth to their
second child ARA JANE on June 18, 2004. At this point in time, their expenses
almost doubled and GINA could no longer make both ends meet. Moreover,
MARCELINO’s inconsistent income was spent for his vices ranging from too much
drinking, compulsive gambling and cockfighting. He did not miss any wake in the
neighborhood in their barangay and even in adjacent barangays, as well as in
other places just to gamble;
25. Furthermore, MARCELINO’s
paranoia became more and more prevalent as always suspects any man talking to
GINA or near her to be having an affair with his wife. He prevented his wife
from attending Barangay Nights, Town Fiestas, and related occasions. To go in
trainings and seminars would cost GINA unending arguments, invectives and
curses from her husband, pleas and tears before she would be permitted;
26.As time passed by, marriage was not growing for the
better and MARCELINO’s supposed respect for his wife-GINA seemingly
disappeared. More than that, MARCELINO was becoming extremely indolent and
dependent on GINA’s meager salary and from his parent’s money being sent by his
siblings from abroad to defray expenses for his vices. MARCELINO became too
irresponsible not just as a husband but also as a father to two children;
27. Then eventually, in 2008,
MARCELINO’s sisters wanted to get him to Paris to work as an OFW like them.
Inasmuch as GINA loves MARCELINO and could not also afford being away from him
even thought he was causing her problems of sorts, GINA considered this
opportunity offered to her husband with much positivity hoping that MARCELINO
will change and become a better person, be focused in life and work for his
family, or at least, for his two children. GINA took the same as an avenue for
her husband to develop his sense of responsibility for the benefit of their
family and welfare of their children;
28.On September 27, 2009, MARCELINO left his wife-GINA and
two children from Paris, France. Before leaving, however, MARCELINO vehemently
commanded GINA to stop working the moment he would start sending money for
them, and out of GINA’s love and respect to her husband, she agreed but
considerately asked form him that she have to finish the incumbent school year
before quitting her work as a Day Care teacher. At the end of the school year,
GINA complied with her promise so that she became a fulltime mother and
homemaker to their two children.
29.
Unfortunately, MARCELINO’s promise was not quite fulfilled. He
rarely sent money, and if he did, it was not even enough for the support of
their kids so that GINA had to ask help from her parents, siblings and other
relatives as she already quit from her work;
30. GINA vividly remembers that on
June 25, 2010, GINA and her children decided to sleep in the living room
because it was warm that night. As she was sleeping, she felt that someone was
touching her leg, and thinking that it was an insect, she tried to swipe it but
only to find out that it was her father-in-law who tried to molest her.
Immediately the next day after the incident, GINA and her children left
MARCELINO’s family house and went back to their house in Barangay An-Annam
East, Bantay, Ilocos Sur;
31.
Herein –petitioner GINA promptly called her husband overseas to
tell him what happened and why she and her kids left MARCELINO’s family house
but sadly, the latter did not believe her, MARCELINO had this thought and
belief that it was GINA who might have made the first move and seduced her
father-in-law. Later that day, MARCELINO called GINA and told her over the
phone that he called his parents and asked for his father’s explanation, and
the father reversed the story that it was GINA who was seducing his
father-in-law, and this was what MARCELINO believed. MARCELINO then shouted,
belittled, berated and thrown invectives unto GINA over the phone and accused
GINA to be a dirty woman and wife.
32. From then on, MARCELINO cut all
communications and he and totally stopped any financial. support to her and the
kids. GINA was left with no choice than to go back to work and luckily she was
admitted by the MSWDO of Bantay, Ilocos Sur, and with her meager salary, she
tried and still tries to stretch it for her children's support aside from help
given her siblings and relatives;
33. Then, GINA learned from friends
and also saw in the social networking site-FACEBOOK that MARCELINO was and
still is in an intimate relationship with another woman whom she later cane to
know as ANTONNETE FOLLANTE. In fact, GINA was able to confirm that her
husband-MARCELINO and this woman ANTONNETE are living together under one roof
in Paris, France. She was also able to confirm that MARCELINO and his sisters-
siblings were the one who helped and provided ANTONNETE the financial resources
go to Paris, France and work thereat
34. Upon learning the appalling
news, GINA tried her best to communicate with MARCELINO, and to her dismay and
great disappointment, MARCELINO was even proud admitting to GINA and telling
her blatantly, like in her face, that he is living with another woman abroad
and he does not love and care about her (GINA) anymore;
35. Herein petitioner-GINA R.
MADRIAGA also vividly remembers that sometime in March, 2011, she had an
appendectomy and because she did not have any income as she already quit from
work, she had to ask money from MARCELINO but only to get the latter's reply in
Ilocano: "Maka-ammo ka met ta biag mon ah." (You be the one to deal
with your life now.) With this, GINA had to beg help from family members,
relatives, and friends;
36. Because of the traumatic
experience that GINA had with her father-in-law, she really contemplated
leaving Bantay, Ilocos Sur were it not for her children who continue going to
school in the same place and also because she is continuously being given
assistance by her siblings and relatives thereat;
37. However, as she also has
friends and distant relatives in Pasuquin, Ilocos Norte, she planned and
decided to apply for work in Pasuquin, Ilocos Norte probably even the same work
or related with that she has at the present with the intention to get her kids
with her after she would be able to properly establish thereat. GINA's
primordial consideration is to totally forget the past and move on in a new
environment not to be continuously haunted by the horrific incident and to,
once and for all, distance herself from the place or environment which hurt her
so much and destroyed her plans and even her life
38. In view of the foregoing, she
started to establish her residence at Brgy. Carusipan, Pasuquin, Ilocos Norte
since the year 2013 and plans to take her kids with her,
39.Petitioner suffered several painful and heart-aching
years from the insensitive ways of her uncaring and unloving husband, and
despite all her efforts to their marriage, doing all her marital duties and
obligations respondent never reciprocated, hardly even once. The recurrent
inability for respondent to perform his supposed marital duties and
responsibilities particularly the needed mutual love, respect, and fidelity is
(was) a function of his dysfunctional personality which traces back to his
rearing and upbringing, dating back even prior to his marriage to petitioner;
40.
Herein petitioner finally realized and felt that she is no
longer happy with respondent and firmly believes that respondent has an
attitude problem or a personality disorder. Despite this feeling, however,
petitioner still tried to give their marriage a chance but respondent never did
his part and continued to neglect his wife and children and disregarded his
family;
41. Respondent-MARCELINO MADRIAGA's
act of infidelity compulsive gambling, lack of sympathy and empathy unto
petitioner uncaring and unmindful of their children, absence of love, care and
affection towards petitioner, and his being unable to perform his marital
duties and obligations for mutual love, respect, fidelity and support depicts a
husband who is severely deficient very much incapable to perform his spousal
duties, not simply because he intentionally refuses to do so, but such results
from a deeper cause/reason which is respondent's psychological incapacity to
fulfill his marital obligations and responsibilities;
42.It is pretty apparent and obvious that respondent
MARCELINO did not really love herein petitioner-GINA R. MADRIAGA but was only
deeply infatuated to her, and with the hidden purpose that MARCELINO only
wanted to have a child with GINA because as he was then telling her, he (MARCELINO)
did not want to become like his uncle who was not able to sire a child. This
was just his primary and hidden objective he lured GINA into marrying him, and
this is what GINA feels
43. To MARCELINO, herein
petitioner-GINA MADRIAGA was more of a conquest than a wife to love and
treasure. His being too jealous, insecure, suspicious, and paranoid was an
overt display of his deep obsession to GINA, and to reiterate, MARCELINO's
motivation to have GINA marry him was only that he wanted to have a child with
her so that he would not be like his uncle who was not able to sire a child. No
love, no respect, no mutual marital obligation to consider and perform;
44.
To further prove this, when MARCELINO was sure that GINA fell in
his hands and arms as his wife, he already displayed the real persona he really
was, irresponsible husband and father who is unable to perform his marital
duties and obligations;
45.In view of all the foregoing facts and circumstances, and
petitioner having taken the extra mile to give her marriage to respondent a
chance that only ended in futility considering that she and her kids are
continuously neglected by the respondent, she decided to have said marriage
severed, hence, this instant Petition for the Declaration of Nullity of a Void
Marriage based on Article 36 of the Family Code;
46.
Such being the case, and prior to the filing of this petition,
petitioner engaged the services of a psychologist examine and assess the
psychological capacity or to incapacity of the petitioner and/or the respondent
based on the foregoing facts and circumstances. The Report and Evaluation of
said psychologist proving the psychological incapacity of respondent will be
submitted and marked later on during the preliminary/pre-trial conference;
47.Based on such examination and assessment, these repeated
acts and manifestations of respondent's shortcomings suggest his maladaptive
attitude behavior that meet the diagnostic criteria of a person. afflicted with
Narcissistic Personality Disorder (NPD) Moreover, respondent's failure to
provide the needed financial support as the supposed provider for the family
because of his inability to curtail his impulsiveness with his vices resulting
in further irresponsibility to the needs of his children coupled with his act
of infidelity results in a marital dysfunction arising from respondent's
psychological incapacity,
48.
Such psychological incapacity characterized by juridical
antecedence that has already been existed long before respondent contracted or
entered into marriage with petitioner, and the same having been deeply
ingrained in his system that molded his personality structure, is also serious,
permanent, and incurable. This enduring pattern has been inflexible and
pervasive as respondent exhibits irresponsibility towards his wife and his
children. manifested by his lack of financial, moral, psychological and
spiritual support for them. and by his utter disregard over his wife's/
petitioner's feelings and sensitivities indicative of respondent's lack of
respect and consideration towards the former;
49.
This behavior that is unlikely of a family man and which is a
clear manifestation of his personality disorder has definitely impaired his
marriage and moreover, his discordant acts of mentally and emotionally hurting
the petitioner has been chronic and severe to the extent that it has caused
much pain and stress on the part of petitioner, causing her to become depressed
and unhappy from the celebration of their marriage and even up to the present;
50.For petitioner and respondent to still continue with a
failed and dysfunctional marital union absent the essential ingredients such as
mutual love, respect, fidelity, as well as loyalty and compassion attributable
to respondent's psychological incapacity would not only be the height of
injustice for both spouses but also a manifest disrespect to marriage which
social is institution the purpose of which is to unite two persons of the
opposite sex to establish a healthy and meaningful family life. By way of
emphasis, respondent's psychological incapacity to perform his marital duties
and obligations characterized by juridical antecedents seriousness, permanence
and incurability, reconciliation between the spouses is far from reality.
Hence, their marital bondage must now be severed and be declared a nullity.
WHEREFORE, premises considered, it is
most respectfully and considerately prayed, on bended knees, that after
compliance with the necessary requisites of due process, judgment be rendered
by this Honorable Court:
1.
DECLARING the Respondent as psychologically incapable of
performing his essential marital duties and obligations under Article 36 of the
Family Code
2.
DECLARING the marriage of Petitioner and Respondent as NULL or
VOID under Article 36 of the Family Code of the Philippines;
3.
GRANTING other reliefs deemed just and reasonable under the
circumstances, and those which are incidental and necessary thereto.

Upon Extra-Judicial Petition for sale under Act 3135, as
amended, filed by San Joaquin Multi-Purpose Cooperative, a domestic corporation
duly existing under and by virtue of the laws of the Philippines with office
address at Brgy. 1, San Joaquin, Sarrat, Ilocos Norte represented by Manager
Elena M. Garcia against Florida Crisostomo and Antonio Crisostomo at Brgy. San
Julian, Solsona, Ilocos Norte to satisfy the mortgage indebtedness which as of
November 25 2016, amounting to NINETY THOUSAND SIX HUNDRED SEVENTY FIVE PESOS
(P90,675.00) exclusive of accrued interests, attorney's fees, penalties and
other charges to date and the expenses of this foreclosure, the undersigned or
his duly authorized deputy will sell at public auction on JANUARY 10 2017 at
