          In compliance with Section 5 of R.A. Act No. 9048, a notice is hereby served to the public that CHARLENE LALIC TUMAMAO has filed with this Office a petition for change of first name from JULITA to COLETA in the birth certificate of JULITA FIESTA CALAMAYAN who was born on 06 March 1963 at Sarrat, Ilocos Norte and whose parents are GABRIEL A. CALAMAYAN and CARMEN FIESTA.
          Any person adversely affected by said petition may file his written opposition with this Office not later than Oct. 2, 2017.

ORDER
          Before this Court is a petition for the assistance in the liquidation of the Community Rural Bank of Dingras (Ilocos Norte), filed by the Philippine Deposit Insurance Corporation.
The petition contains the following averments:
“FACTS OF THE CASE
1.       On November 3, 2016, pursuant to the Resolution No. 1956.A issued by the Monetary Board of the BangkoSentral ng Pilipinas (BSP), COMMUNITY RB DINGRAS Was prohibited from doing business in the Philippines and designated PDIC as Receiver of COMMUTY RB DINGRAS with a directive to proceed with the takeover and liquidation of the Bank in accordance with Section 12(a) of the PDIC Charter, and on the following grounds:
“On the basis of the examination findings as of 31 October 2015, as reported by the Integrated  Supervision Department (ISD) II, in its memorandum dated 12 October 2016, which report showed that Community Rural Bank of Dingras (Ilocos Norte), Inc. (Community RB Dingras) (a) has insufficient realizable assets to meet its liabilities; and (b) cannot continue in business without involving probable losses to its depositors and creditors, and that the losses are likely to continue and, based on existing circumstances and conditions evaluated by ISD II, It is unlikely that the chronic losses will be reversed; considering the failure of the Board of Directors/ Management of Community RB Dingras to cause the infusion of adequate capital and restore the Bank’s financial health and viability, and address it financial and operational problems despite considerable time given; and that the Bank had been accorded due process, the Board, in accordance with Section 30 of Republic Act (R.A.) No. 7653 (the New Central Bank Act), approved the recommendation of ISD II, endorsing as follows:
1.       To prohibit Community RB Dingras from doing business in the Philippines; and
2.     To designate the Philippine Deposit Insurance Corporation (PDIC) as Receiver of the Bank and direct PDIC to proceed with the takeover and liquidation of the Bank in accordance with Section 12(a) of R.A. No. 3591 (The PDIC Charter), as amended.”
A certified true copy of the Monetary Board Resolution No. 1956.A dated November 3, 2016 is attached hereto as ANNEX “A”.
2.  Consistent with, and on the strength of the said Resolution, petitioner took over as the assets and affairs of the COMMUNITY RB DINGRAS on November 4, 2016. Attached is the certified true copy of the Takeover Report on COMMUNITY RB DINGRAs dated March 14, 2017 marked as ANNEX “B”
3.  Under section 12 (a) of the PDIC Charter, whenever a bank is ordered closed by the Monetary Board, the PDIC shall be designated as receiver and it shall proceed with the takeover and liquidation of the closed bank.
4. Petition anticipates that in the course of the liquidation of COMMUNITY RB DINGRAS, disputed claims, issues and other matters material or relevant to the liquidation of COMMUNITY RB Dingras may arise. Corollary thereto, Section 16( 1) of the PDIC Charter, provides that all persons or entities with claims against the assets of the closed banks shall file their claims with the receiver within sixty (60) days from the date of publication of the notice of closure shall be disallowed. Claims denied by the receiver shall be filed with the liquidation court within sixty (60) days from receipt of the final notice of denial of claim.
5. Thus, pursuant to Section 30 of R.A. 7653, petitioner seeks the assistance of the Honorable Court in the resolution of the disputed claims and relevant issues pertaining to the liquidation of COMMUNITY RB DINGRAS.
6. Notice to Creditors on filing or claims was published in The Philippine Star on November 21, 2016 advising persons or entities with claims against the assets of the Bank to file their claims with the receiver within sixty (60) days from date of publication or until January 20, 2017, the last day for filing or claims against the assets of the Bank.
Attached is the original Affidavit of Publication of the Notice of Creditors relative to the November 2, 2016 issue of The Philippine Star marked as ANNEX “C”
7. As of January 20, 2017, forty-six (46) claims aggregating P68,243,663.89 of the total estimated liabilities of P83,526,980.35 as of November 30, 2016 were filed as shown on pages 37 and 38 of the Takeover Report1.
8. Petitioner hereby submits a certified true copy of the Master Liquidation Plan for the Conduct of Liquidation of Closed Banks, which was duly adopted and approved by its Board of Directors on January 18, 2017 per Resolution No. 2017-01-009 to govern the conduct of liquidation of PDIC for banks closed after June 11, 2016, pursuant to the PDIC Charter. The certified true copy of the Master Liquidation Plan for the Conduct of Liquidaiton of Closed Banks is attached hereto as ANNEX “D”.
9. Insofar as relevant to this petition, the Supreme Court held in Pacific Banking Corporation Employees Organization vs. Court of Appeals, et.al. (242 SCRA 492);
“A liquidation proceeding as a single proceeding which consists of a number of cases properly classified as claims. It is basically a two-phased proceeding. The first phase is concerned with the approval and disapproval of claims. Upon the approval of the petition seeking the assistance of the court in the liquidation of a closed entity, all money claims against the bank are required to be filed with the liquidation court. This phase may end with the declaration by the court that the claim is not proper or without basis. x xx
The second phase involves the approval of the court of the distribution plan prepared by the duly appointed liquidator. x  xx The order finally disposes of the issue of how much property is available for disposal. Moreover, ushers in the final phase of the liquidation proceeding, payment of all allowed claims in accordance with the order of legal priority and the approved distribution plan.”
          Finding the petition to be sufficient in form and substance, the same is hereby set for hearing on October 12, 2017 at 10:00 o’clock in the morning, in the sala of Branch 15 of this Court, Second Floor, Marcos Hall of Justice, Laoag City, at which date, time and place, any person interested may appear and show cause why the petition should not be granted.
          Let copies of this Order be served upon the COMMUNITY RURAL BANK OF DINGRAS (ILOCOS NORTE), INC.; and let copies of this Order be posted at the premises of the Court, the Provincial Capitol, and the premises of the bank/s.
          Let this Order be published at the expense of the petitioner once in a newspaper of general circulation.

          A verified petition has been filed by the petitioner thru counsel wherein he prayed that after due notice and hearing, judgment be rendered directing the Local Civil Registrar of Sarrat, Ilocos Norte City and the Philippine Statistics Authority Office, Civil Registrar General, Manila to make corrections in the birth record of petition Barry BaroniaBaoit by correcting the name of his mother appearing thereon from NORMA DE GUZMAN BAOIT to NORMA DE GUZMAN BARONIA.
          Finding the petition to be sufficient in form and substance, the hearing of the same is set on October 18, 2017 at 8:30 in the morning before this Court sitting at the ground floor of the Marcos Hall of Justice, Laoag City.
