ORDER
A verified petition has been filed by the petitioner wherein he prayed the Court that after due notice, publication and hearing the holographic will of the late BASILIA S. ANDRES be declared her last will and testament and that the petitioner be appointed as executor and/or administrator of her estate and serving as such without a bond. The petitioner likewise prayed for other just and equitable reliefs.
Finding the petition to be sufficient in form and substance, the hearing of the same is hereby set for September 27, 2017 at 8:30 A.M. before this Court sitting at the ground floor of the Marcos Hall of Justice, Laoag City, at which date, time and place all concerned may appear to contest the allowance of the holographic will. Let copies of this order be published once a week for three (3) consecutive weeks in a newspaper of general circulation in the Province of Ilocos Norte prior to the date of hearing and be furnished to the children of the late BASILIA S. ANDRES and other heirs mentioned in the petition as follows:
WILFREDO S. ANDRES, SR., with residence and postal address at No. 105 Gen. Segundo Ave., Brgy. 11, Laoag City, Philippines.
ADRIANA S. ANDRES-FISHER, with residence at No. 20 Mainsail Xing, Savannah, Georgia, United States of America, 31411-2723
ELIEZER R. ANDRES, JR., ETHELWYN ANDRES-ACIERTO and EMILY REYES ANDRES (maiden name), with address at Our lady of Miraculous Medal School, Phase IV, Block 21, Lots 4-6, Pacita Complex, San Pedro, Laguna.
ESTRELITA REYES-ANDRES and ELAINE REYES-ANDRES (maiden names), whose respective addresses at present are unknown to the petitioner.

ORDER
Before this Court is a verified petition for the recognition and/or confirmation of a foreign judgment of divorce, filed by herein petitioner, Marcelo Salvador Balicao.
It is alleged in the petition that petitioner is of legal age, married, Filipino citizen and a resident of Brgy. Madayegdeg, San Fernando City, La Union. Petitioner allege that he and herein private respondent, Rheamay Apostol Balicao were married on 27 April 2013 before the Christian Community Church, Brgy. 11, Sarrat, Ilocos Norte. After the marriage respondent went back to the State of Hawaii, United States of America where she is a resident and after a year, respondent took a very brief vacation in the Philippines and informed petitioner that their relationship is over.
On 09 May 2016, a Divorce Decree was issued by the Family Court First Circuit, State of Hawaii, dissolving the marriage of the petitioner with the private respondent. The divorce decree was issued pursuant to Chapter 580, Hawaii Revised Statutes, including any amendments from the 2015 HRS supplements, more in particular PART III. DIVORCE – 580-41, which provides:
“The family court shall decree a divorce from the bod of matrimony upon the application of either party when the court finds:
The marriage is irretrievably broken.
The parties have lived separate and apart under a decree of separation from bed and board entered by any court of competent jurisdiction, the term of separation has expired and no reconciliation has been effected;
The parties have lived separate and apart for a period of two years or more under a decree of maintenance entered by any court of competent jurisdiction, and no reconciliation has been affected; or
The parties have lived separate and apart for a continuous period of two years or more immediately preceding the application, there is no reasonable likelihood that the cohabitation will be resumed, and the court is satisfied that, in the particular circumstances of the case, it would not be harsh and oppressive to the defendant or contrary to the public interest to a divorce on this ground on the complaint of the plaintiff.”
That in order to avoid the awkward situation where petitioner remains to be married to a person who is capacitated to marry under the laws of the State of Hawaii, the instant petition is hereby initiated.
Finding the petition to be sufficient in form and substance, this Court sets the same for hearing on September 29, 2017 at 9:00 o’clock in the morning, in the sala of Branch 15, Regional Trial Court, Second Floor, Marcos Hall of Justice, Laoag City, at which date, time and place, any interested person may appear and show cause why the petition should not be granted.
Let copies of the Petition and this Order be served upon the Local Civil Registrar of Sarrat, Ilocos Norte, the Civil Registrar General, Philippine Statistics Authority, Manila, the Office of the Solicitor General, and the Office of the Provincial Prosecutor.
Let this Order be published at the expense of the petitioner once a week for three (3) consecutive weeks in a newspaper of general circulation in the Province of Ilocos Norte.
Let summons be issued to private respondent in her given address in the petition. In addition it appearing that the private respondent is an American citizen and the foreign divorce decree was obtained in the State of Hawaii, where she is a resident, the petitioner is directed to coordinate with this Court’s Sheriff, to ensure that summons is likewise served to respondent’s last known address in the State where the decree of divorce was granted.
