This
is a verified Petition filed by petitioner Marianne R. Garcia of 472, Violet
St., Rainbow Village, Angono, Rizal. Impleaded as parties-respondents are Bruce
L. Garcia, the petitioner’s legal husband, a citizen of the United States of
America, a resident of 22407, Halldale Avenue, Torrance, California, 90501, USA
and his Philippine address is Brgy. 15, Baligat, Batac City; the Local Civil
Registrar of Batac City and the Civil Registrar-General, National Statistics
Office (NSO), Quezon City.
The
petitioner alleged in her petition that they got married with the private
respondent on August 30, 2002 in Batac City and they were both Filipino
citizens. Private respondent migrated to USA and eventually acquired American
citizenship on November 22, 2004. In August 13, 2015, private respondent filed
a Petition for Dissolution of Marriage against the petitioner and was
eventually granted by the Superior Court of California, County of Los Angeles.
On the Dissolution Decree, their marriage was terminated effective October 15,
2015. She further alleged that the State of California allows dissolution of
marriage, particularly the California Family Code, Division 6, Part 3, under
Sections 2300 to 2542. The Decree of Dissolution secured by the private
respondent, as granted, conforms to said Family Law of the State of California,
particularly Section 2310, laying irreconcilable differences as the ground
relied upon in the petition. Consistent with Article 26 of the Family code of
the Philippines and the ruling of the Supreme Court in the case, Corpuz vs.
Sto. Tomas (GR No. 186571), she filed this petition and prayed that after due
notice and hearing the Dissolution Decree obtained by the private respondent be
judicially recognized and enforced as valid; that an order be issued directing
the public respondents Local Civil Registrar of Batac City and NSO Civil
Registrar General to annotate the fact of the Dissolution Decree in the
marriage certificate of the petitioner and private respondent and declare the
petitioner capacitated to remarry.
Finding
the petition to be sufficient in form and substance, the same is hereby given
due course by setting it for hearing on March 31, 2017 at 2:00 o’clock in the
afternoon. Any person/s who may have an interest in or maybe adversely affected
by the petition may file his, her or their written opposition to the petition
or may personally appear in Court on such dates of hearing to signify their
opposition thereto and to show cause why the petition should not be granted.
Let
copies of the petition and this Order be separately furnished the Office of the
Solicitor General, Manila; the Office of the City Prosecutor, Batac City;
respondents Local Civil Registrar of Batac City and the Office of the Civil
Registrar General, National Statistics Office, Manila.
And
further, let this Order be published in any newspaper of general circulation in
the entire province once a week, for three (3) consecutive weeks, at the
expense of the petitioner.
Let
also a copy of the Petition and its Annexes together with a copy of this Order be furnished the
respondent at his given address at 22407, Halldale Avenue, Torrance, California
90501, USA by registered air mail with return card, and at this Philippine
address at Brgy. 15, Baligat, Bataac City.
The
respondent is hereby given a period of sixty (60) days from the last
publication within which to submit his Answer/Comments to the petition.
SO
ORDERED.
