Laoag City council oks holiday-with-pay benefit for JO, CoS workers



Laoag City—The 13th Sangguniang Panlungsod of Laoag has approved an ordinance granting holiday-with-pay benefits to job order (JO) and contract of service (CoS) workers of the city government, citing the constitutional right to health, the Mental Health Act, and related civil service issuances.

The proposed measure, titled “Holiday with Pay Benefit of the JO and CoS Workers of Laoag City,” seeks to extend to JO and CoS personnel a benefit similar to the wellness leave granted by the Civil Service Commission to government workers under Resolution No. 2501292 and Memorandum Circular No. 01, Series of 2026. The ordinance also cites Republic Act No. 4622, which provides for the payment of regular daily wages to government laborers and employees during special public holidays.

Under the ordinance, all Laoag City Job Order and Contract of Service workers, regardless of length of service, are entitled to holiday leave with pay during regular, special and local holidays, except those assigned to frontline, emergency or exigency service. These include personnel in health services, emergency response, disaster preparedness, peace and order, vital public services and other key functions as determined by the appointing authority.

The ordinance defines Contract of Service workers as individuals or entities engaged for special projects or technical services within a specific period, while Job Order workers are those hired for piecework, intermittent or emergency tasks such as clearing debris or performing basic trades and manual services. It also defines emergency or exigency service as work conditions where employee presence is essential to critical public service operations.

The measure further provides that the contracts of JO and CoS workers must include a provision on the benefit for proper guidance of both parties. Holiday leave with pay may not be availed of if the appointing authority deems attendance necessary for the commemoration or celebration of the holiday, and the benefit is non-cumulative and non-commutable to its monetary equivalent. It applies only to holidays covered by law, including those under Republic Act No. 9492 and local holidays, and may be availed only from Mondays to Fridays.

The ordinance states that it will take effect upon approval by the local chief executive and compliance with the required posting period.
