ORDER
                   This pertains to a motion filed on September 6, 2016 seeking to amend the Decision of the Court rendered on February 29, 2016 and which has already attained finality on March 30, 2016, more particularly the first paragraph of the dispositive portion thereof where there was a typographical error with regard the share of the late Mariano Jove Dacuycuy over Lots Nos. 315 and 850 of the Bacarra Cadastre, which should be corrected to ¼ instead of 1/3.
          As a general rule, when a judgment has become final and executory, such judgment may no longer be modified by the court which rendered such judgment or by any other courts except under three exceptions: a) clerical errors; b) nunc pro tunc entries which cause no prejudice to any party; and c) void judgments.1
          Nunc pro tunc judgments have been defined and characterized in the following manner:
          “The object of a judgment nunc pro tunc is not the rendering of a new judgment and the ascertainment and determination of new rights, but is one placing in proper form on the record, the judgment that had been previously rendered, to make it speak the truth, so as to make it show what the judicial action really was, not to correct judicial errors, such as to render a judgment which the court ought to have rendered, in place of the one it did erroneously render, nor to supply nonaction by the court, however erroneous the judgment may have been. (Wilmerding vs. Corbin Banking Co., 28 South., 640, 641; 126 Ala., 268)2
          Finding the motion to be in conformity with the evidence presented, the same is hereby granted.
          WHEREFORE, the motion is granted and this Court hereby issues this Order nunc pro tunc for the amendment of the dispositive portion of the February 29, 2016 Decision so that it should now read as follows:
1.       Declaring the plaintiff’s predecessor-in-interest Mariano Jove Dacuycuy as having successional rights over Lot Nos. 315 and 850 of the Bacarra cadastre, equivalent to ¼ share from each lot as the same belongs to Spouses Nicolas Dacuycuy and Ambrosia Jove;
2.     Declaring the Affidavit dated June 21, 1996 executed by defendant Catalina Lolita Dacuycuy Acoba void in so far as it deprived Mariano Jove Dacuycuy of his share in Lot Nos. 315 and 850;
3.      Directing public defendant Provincial Environment and Natural Resources Office of Ilocos Norte to cancel Free Patent Nos. 012802-08-36922 and 012802-08-36923;
4.     Directing public defendant Register of Deeds of Ilocos Norte to cancel for being null and void Katibayan ng Orihinal na Titulo Blg. P-83671, both in the name of the late Flor Percival J. Dacuycuy
5.     Ordering the partition of Lot Nos. 315 and 850 as follows: Catalina Lolita Dacuycuy Acoba, ¼ share; Mariano Dacuycuy, represented by his heirs including plaintiff Wilfred Dacuycuy, ¼ share; Flor Percival Dacuycuy represented by his heirs Erlinda Dacuycuy and Alex Dacuycuy, ¼ share; and the late Carmen Jove Dacuycuy, represented by her son Alex Dacuycuy, ¼ share. In this regard, the plaintiff and private defendants are hereby directed to submit a project of partition of the two lots for the approval of the Court;
6.     Ordering private defendants especially Erlinda Dacuycuy and Alex Dacuycuy as heirs of Flor Percival J. Dacuycuy to reconvey to plaintiff in his capacity as the representative of the heirs of the late Mariano Jove Dacuycuy the latter’s successional share over the subject lots as apportioned in par. 5 above, specifically ¼ or 243.25 square meters of Lot No. 315 and 214 square meters of Lot No. 850. In case said private defendants fail in this respect within sixty (60) days from notice, the Court shall allow plaintiff to execute the necessary deed or instrument for the purpose of reconveying said portions of the subject lots in favour of the late Mariano Dacuycuy.

Anent plaintiff’s motion for the publication of the corrected dispositive portion of the Decision, the same is hereby granted in accordance with Rule 13, Sec. 9 of the Rules of Civil Procedure which states that “Judgments, final orders or resolutions shall be served either personally or by registered mail. When a party summoned by publication has failed to appear in the action, judgments, final orders or resolutions against him shall be served upon him also by publication at the expense of the prevailing party” [Emphasis supplied.]
Let therefore a copy of this Order be published through a duly accredited newspaper of general circulation in Laoag City and Ilocos Norte.

Pagudpud’s tourism transformer passes away

Ricardo Nolasco Jr., owner of Hannah’s Beach Resort and Convention Center in Pagudpud, Ilocos Norte passed away on Wednesday evening, July 11, 2018. He was 67. “He did not survive an open-heart surgery,” said Ronald Dominguez, spokesperson of the largest resort at Brgy. Balaoi in Pagudpud. Known as the architect behind the transformation of Pagudpud town as a premiere destination of the north, Mr. Nolasco put up Hannah’s Beach Resort in what was originally meant as a family vacation resort.
