            Whereas, an Amended Complaint was filed in the above-entitled case before this Court on March 25, 2015 which reads as follows:

AMENDED COMPLAINT

            COMES NOW the Plaintiff, through the undersigned counsel, unto this HONORABLE COURT most respectfully avers that:
1.        Plaintiff is of legal age, married, Filipino citizen and a resident of Brgy. 28, M.H. del Pilar St., Laoag City, as evidenced by the machine copies of her two competent evidences of identity, hereto attached as Annexes “A” and “B”, where she may be served with lawful orders and/or processes of this Honorable Court.
2.      Defendants are all of legal age, Filipino citizens, and residents of the following: JESUS D. GAOIRAN, Brgy. Pasiocan, Bacarra, Ilocos Norte; FLOCELIA G. FUERTE, Brgy. Pasiocan, Bacarra, Ilocos Norte; DONNALYN G. BUCAO, Brgy. 18, MH del Pilar St., Laoag City; EVALOR A. MIGUEL, Brgy. Baduang, Pagudpud, Ilocos Norte; EDEN DACANAY, Brgy. 60, Calayab, Laoag City; PEPITO DACANAY, 32-B, Sta. Maria, Laoag City; FE CONSTANTINA D. CRISOLOGO, Brgy. 2, San Agustin, Sarrat, Ilocos Norte; LETICIA D. PALAFOX, Brgy. 18, JP Rizal St., Laoag City; REYNALDO DACANAY, Brgy. 18, JP Rizal St., Laoag City, where they may be served with summons, lawful orders, and/or legal processes of this Honorable Court.
3.       For the unknown heirs of MAXIMINO MIGUEL, ALEJANDRO MIGUEL, TOMASA MIGUEL-BAYAWA, ROSIA PADACA, summons may be served through publication.
4.      Plaintiffs and defendants are co-owners, being the remaining intestate heirs of Paula Padaca, Isidora Padaca, Flora Padaca, and Rosia Padaca who all died as widows and left parcels of land located in Laoag City covered by Transfer Certificate of Title No. T-23798, machine copy of which is hereto attached as Annex “C”, and specifically described as:
A parcel of land (Lot 9562-B, on the subdivision plan, Psd-012812-022833, being a portion of Lot 9562, Cad. 195, Laoag Cadastre, LRC Rec. No. 1203), situated at Brgy. San Quirino, Laoag City, Island of Luzon. Bounded on the NE., along line 6-1 by Drainage Canal; on the SE., along line 1-2 by Lot 9562-A, on the subdivision plan; and on the NW, along line 5-6 by Jocson St. containing an area of ONE HUNDRED EIGHTY SEVEN SQUARE METERS AND SEVENTY TWO SQUARE DECIMETERS, more or less.xxx
            XxxPAULA PADACA, the wife of Ildefonso Miguel, 73 sq. m. eastern portion; ISIDORA PADACA, widow, 20.86 sq. m.; FLORA PADACA, widow, 12.166 sq. m.; and ROSIA PADACA, widow, 20.86 sq. m., all of legal age Filipino citizens and residents of Laoag City, Philippines.

5.      That the immediately aforementioned parcels of lot are declared under Tax Declaration No. 08-028-00303, a machine copy of which is hereto attached as Annex “D”, with a collective assessed value of P68,480 for the current year.
6.      That PAULA PADACA died as a widow on September 16, 1956 in Laoag City, Philippines and was survived by eight children: MAXIMO MIGUEL, RAMON MIGUEL, ASUNCION CONSOLACION MIGUEL-DACANAY, TOMASA MIGUEL-BAYAWA, JOSE MIGUEL, FILOMENA MIGUEL, MODESTA MIGUEL and BIBIANA MIGUEL. All of the aforesaid surviving heirs died without any issue except ASUNCION CONSOLACION MIGUEL-DACANAY, MAXIMO MIGUEL, ALEJANDRO MIGUEL and TOMASA MIGUEL-BAYAWA.
7.      ASUNCION CONSOLACION MIGUEL-DACANAY was survived by CECILIA DACANAY-GAOIRAN, INOCENCIA DACANAY-AGUINALDO, HIPOLITO M. DACANAY, Defendant LETICIA DACANAY-PALAFOX, Defendant REYNALDO M. DACANAY, and the herein Plaintiff.
8.      MAXIMO MIGUEL, ALEJANDRO MIGUEL and TOMASA MIGUEL-BAYAWA were survived by unknown heirs.
9.      CECILIA DACANAY-GAOIRAN died and is survived by herein Defendants JESUS D. GAOIRAN, FLOCELIA G. FUERTE, and DONNALYN G. BUCAO;
10.   INNOCENCIA D. AGUINALDO died and is survived by herein Defendant EVALOR A. MIGUEL;
11.     HIPOLITO DACANAY died and is survived by Defendants EDEN DACANAY, PEPITO DACANAY, and FE CONSTANTINA D. CRISOLOGO;
12.    ISIDORA PADACA, FLORA PADACA and ROSIA PADACA are siblings of PAULA PADACA. ISIDORA PADACA and FLORA PADACA both died without issue. Hence, the parties herein are their only remaining compulsory heirs while ROSIA PADACA died with unknown heirs.
13.    That the estates of Paula Padaca, Isidora Padaca, Flora Padaca, and Rosia Padaca consisting of the aforesaid parcels of land, from the time of their demise up to the present, had remained in a state of indivision, are community property of the plaintiff and the defendants;
14.   That plaintiff, despite demands from the herein Defendants, has solely paid for the annual real property taxes of all the parcels of land covered by Transfer Certificate of Title No. T-23798 since year 1996. Defendants expressly refused to give their shares;
15.    Because of the Defendants’ unwillingness to bear their shares in the payment of the annual real property tax and other indispensable and necessary expenses for the preservation of the same, plaintiff exerted all efforts to have an extrajudicial partition with the defendants over the said parcels of land, however, such efforts became nil and futile. Defendants, without justifiable reasons, have always and still refuse to accede to the same without any justifiable reason or legal excuse. Some of them even threatened the plaintiff for her attempts to partition the property.
16.   Worse, defendants LETICIA D. PALAFOX and REYNALDO DACANAY and their family members are presently occupying the parcels of land which are the subjects of this complaint. Lately, plaintiff discovered that they have constructed concrete structures inside the lots that plaintiff demanded from them to stop the same because such prejudices the rights of the other co-owners. But despite such demands, they still continued such constructions.

Hence, this action.

            WHEREFORE, it is respectfully prayed unto this Honorable Court that, after due notice and hearing, a decision be rendered:

1.        That partition be affected over the parcels of land according to the parties’ per stirpes shares over the parcels of land;
2.      That on the rightful shares of the heirs Asuncion Consolacion Miguel-Dacanay, it shall be distributed in this wise:
a.      1/6 for the Plaintiff;
b.      1/6 for the share of Innocencia D. Aguinaldo died and is survived by herein Defendant Evalor A. Miguel;
c.       1/6 for the successional stirpes of the late Cecilia D. Gaoiran, represented by Defendants Jesus D. Gaoiran, Flocelia G. Fuerte, Glenn D. Gaoiran, and Donnalyn G. Bucao;
d.      1/6 for the successional stirpes of the late Hipolito M. Dacanay, represented by Defendnats Eden Dacanay, Pepito Dacanay, and Fe Constancia D. Crisologo;
e.      1/6 for Defendant Leticia D. Palafox; and
f.        1/6 for Defendant Reynaldo M. Dacanay;
3.       That the Defendants reimburse the Plaintiff their respective shares of all the amounts she spent for the payment of the annual real property taxes and other necessary expenses used for the preservation of the same, with consideration of adjusting the payment of previous years to their present inflation value, with legal interest, as provided for by law;
4.      That defendants LETICIA D. PALAFOX and REYNALDO DACANAY shall pay appropriate civil damages for constructing concrete structures in the aforesaid parcels of land without the consent of other co-owners which resulted to the prejudice and encroachment to their respective rights over the same;
5.      Reimbursements for the costs of the suit, plus an attorney’s fee of P15,000 pesos in Philippine currency, and P1,000 pesos as appearance fee, per hearing;
6.      That in case the other co-owners cannot reimburse foregoing taxes, fees, suit’s cost, among others as aforementioned, it shall be deducted from their respective shares in favor of the Plaintiff;
7.      Other just and equitable relief and remedies are likewise prayed for.

PIDS expert says income tax cuts justified; warns gov’t of revenue loss

Proposals to amend the personal income tax schedule appear to be well-justified. However, these proposals should include measures that will allow government to recover the revenue loss from lower income taxes. Dr. Rosario Manasan, senior research fellow of state think-tank Philippine Institute for Development Studies (PIDS), said at a seminar sponsored by the Philippine Senate, that government should look for new revenue measures to compensate for the projected revenue loss that will arise as a result of the implementation of any of the various proposals to restructure the personal income tax. Currently, there are several income tax reform proposals pending in both houses of Congress. All of them, according to Dr. Manasan, have the same objective of addressing the phenomenon of bracket creep, which results from “non-indexation to inflation of personal income tax brackets”.
